Administrative act. Cancellation of driving license

Abstract

The driving license is correctly cancelled by the disposition of the police officer if the party obtained the license while he was investigated and judged for crimes under the traffic regime.

The circumstance that by the criminal decision it was ordered to suspend the execution of the sentence under supervision has no relevance in terms of taking the administrative measure of the cancellation of the driving license, the provisions of art. 114 paragraph 1 let f from O.U.G. no. 195/2002 making no distinction regarding the way of executing the punishment established for committing offenses under the traffic regime. Holding the applicability of the Constitutional Court Decision no. 280 of May 8, 2014, published in the Official Monitor no. 464 of June 25, 2014.
