Abstract

With the entry into force of the new Civil Code, the legislator enshrined a very important principle, of course applied in judicial practice, but whose regulation was imperatively necessary. We are talking about the principle of exercising rights and obligations in good faith, regulated by art. 14. At the same time, in the same context, the sanction for not exercising rights and obligations in good faith, respectively the abuse of rights, which we find in art. 15.
