Abstract

The proof of fulfilment of the requirement regarding the tender guarantee supposes both the submission of the insurance policy/the insurance contract, and of a document proving the full payment of the insurance premium.

Under the circumstances in which the contracting authority requested, according to art. 209 of Law no. 98/2016, that the tenderer should fill in the documents submitted by filing the proof of full payment of the insurance premium, and the respective tender did not answer to the request within the agreed deadline, the solution of the contracting authority to reject the offer as inacceptable is correct, according to art. 134 paragraph (5) of the Government Decision no. 395/2016.
