Abstract

The article explores the compatibility of the provisions of Article 91 and Article 112¹of the Criminal Code from the perspective of substantive criminal law and criminal procedural law. The paper analyses the suspension of the execution of the sentence under supervision and extended confiscation through the lens of the relevant theoretical conditions of these two fundamental institutions of criminal law: the notion of conviction and the subjective condition of the court.
