Complex issues in the procedure for confirmation of the reorganisation plan

Abstract

The analysis presented aims to set out some of the issues relating to how some legal provisions in insolvency proceedings can be interpreted. They concern: the announcement of the approval and confirmation of the reorganisation plan; where two plans have been submitted, the vote must be taken at the same meeting of the creditors' meeting, in the order decided by the creditors; interpretation of the presumption of voting in the case of non-disadvantaged categories.
