Abstract

The basic form of the abusive conduct offence consists in the use of offending words against a person, by the civil servant in the performance of his work duties.

The act constituting the content of the offence of insult is absorbed into the offence of abusive conduct, when committed by a civil servant or by another office holder in the exercise of his work. Another issue deals with the possibility of applying the truth test in the case of the offence of abusive conduct, in the light of the juridical regime of art. 207 of the Criminal Code.
