ABSTRACT

The Romanian legislator regulated the intervention of the state courts in the arbitration in order to remove the obstacles encountered in the organization or conduct of the arbitration or in order to fulfill other duties of the court in the arbitration.

The article makes a thorough investigation of the intervention of state courts in arbitration, regulated by Art. 547 Romanian Civil Procedure Code and begins with a brief presentation of the institution, as well as the purpose for which it is recognized by law.

Consecutively, the elements of a request based on the provisions of Art. 547 RCPC shall be analyzed, regarding the competent court, the characteristics of the request, the court procedure, the solutions that the court can adopt, the appeals, as well as the consequence of formulating a request in relation to the arbitration period.
