Abstract

Suspension of the execution of the sentence under art. 484 para. 2 of N.C. civ. proc. cannot be justified only by the fact that an appeal against the sentence has been declared, since the legality of the sentence is verified by the court of recourse, based on the grounds of illegality invoked by the appellant. The opportunity to suspend is left to the court's discretion, judging by the reasons invoked by the party and the circumstances of the case if the enforcement of the judgment appealed against (practically, its enforceability), is required to be suspended.
